A petition has been submitted to the Milimani Law Courts, urging the Ethics and Anti-Corruption Commission (EACC) to be compelled to investigate Westlands Member of Parliament Timothy Wanyonyi. Francis Awino, the petitioner, also aims to have the Office of Director of Public Prosecutions (ODPP) press charges against the legislator for alleged misuse of public funds.
According to Mr. Awino, there were unlawful and irregular expenditures of the National Government Constituency Development Fund (NG-CDF) for Westlands Constituency during the 2020 fiscal year. The petitioner asserts that the lawmaker mishandled Ksh.17 million and Ksh.15.4 million designated for bursaries to secondary schools and tertiary institutions. This misuse is alleged due to a lack of supporting documentation, such as applications, approval processes, school and institution acknowledgments, and a list of beneficiaries.
Court documents reveal that Hospital Hill Primary School was allocated Ksh.5.5 million for the construction of a library accommodating 200 pupils. Funds were transferred to the school’s primary bank account in Westlands, and payments were disbursed from there. Mr. Awino further contends that although a donor stepped in to complete the project, the unused funds were never reallocated. Additionally, the validity and completeness of the Ksh.5.5 million transfers remain unverified.
